Historia sporu w strukturze własnościowej Polskiej Telefonii Cyfrowej zaczęła się w momencie sprzedaży przez Elektrim 48 proc. udziałów w PTC spółce Elektrim Telekomunikacja (kontrolowanej przez francuską firmę Vivendi). W 2004 roku Trybunał Arbitrażowy w Wiedniu wydał orzeczenie stwierdzające nieważność tej transakcji. Sąd Najwyższy z kolei uznał kasację ET i skierował sprawę do ponownego rozpatrzenia. Z jednej strony, Elektrim Telekomunikacja uważa, że to jej należy się 48 proc. udziałów w PTC. Z drugiej jednak, pojawia się Deutsche Telekom (operator sieci T-mobile), który kupił od Elektrimu udziały, uznając wyrok wiedeńskiego trybunału.

Wczoraj, 18 czerwca 2008 r., Sąd Okręgowy w Warszawie podtrzymał wyrok Trybunału Arbitrażowego w Warszawie, uznając tym samym strukturę, w której większościowym udziałowcem jest T-mobile.
