Od 20 listopada 2002 r. obowiązuje ustawa, która pozwala Prezydentowi RP ratyfikować konwencję o patencie europejskim. Stronami konwencji są już: Austria, Belgia, Cypr, Dania, Francja, Grecja, Hiszpania, Holandia, Irlandia, Luksemburg, Liechtenstein, Monako, Portugalia, RFN, Szwajcaria, Szwecja, Turcja, Włochy i Wielka Brytania.

Dzięki instytucji patentu europejskiego będzie można uzyskać ochronę w dowolnie wybranym państwie, które jest stroną konwencji. Ochrona patentowa udzielona w jednym z państw – stron konwencji może być rozszerzona na pozostałe. Zgłoszenie w jednym z państw - stron konwencji nie powoduje jednak automatycznie powstania ochrony w pozostałych państwach. Należy wyraźnie wskazać je we wniosku.

O uzyskanie patentu europejskiego będzie można ubiegać się w Urzędzie Patentowym RP, bądź w Europejskim Urzędzie Patentowym.
