Rozporządzenie zostało wydane na podstawie art. 10 ust. 4 ustawy o ochronie przed przywozem na polski obszar celny towarów po cenach dumpingowych. Do celów postępowania antydumpingowego za kraje o gospodarce nierynkowej zostały uznane: Republika Albanii, Republika Armenii, Republika Azerbejdżańska, Republika Białoruś, Chińska Republika Ludowa, Gruzja, Republika Kazachstanu, Koreańska Republika Ludowo-Demokratyczna, Republika Kirgiska, Republika Mołdowy, Mongolia, Republika Tadżykistanu, Turkmenistan, Ukraina, Republika Uzbekistanu, Socjalistyczna Republika Wietnamu.

Zgodnie z § 3 niniejszego rozporządzenia, jeżeli postępowanie antydumpingowe dotyczy towarów, dla których krajem eksportu są Ukraina, Kazachstan, Socjalistyczna Republika Wietnamu lub inny kraj o gospodarce nierynkowej wymieniony powyżej, który w dniu wszczęcia postępowania jest członkiem Światowej Organizacji Handlu – wówczas zagraniczni importerzy lub producenci towaru mogą wystąpić do Ministra Gospodarki, Pracy i Polityki Społecznej o uznanie ich za kraje o gospodarce rynkowej. Warunkiem wystąpienia z takim wnioskiem jest m.in. prowadzenie ksiąg rachunkowych i stosowanie kursu walut o charakterze rynkowym.
