SN podjął uchwałę bardzo istotną dla prowadzących działalność gospodarczą. Wynika z niej, że roszczenie o odsetki przedawnia się co do zasady, tak jak określa to art. 118 k.c., tzn. w terminie 3-letnim. Jeśli jednak istnieje przepis szczególny, przewidujący krótszy termin przedawnienia, to obejmuje on zarówno roszczenie o należność główną, jak i odsetki.

Skład siedmiu sędziów SN, podjął 26 stycznia 2004 r. uchwałę o następującej treści: Ustanowiony w art. 118 k.c. termin przedawnienia roszczeń o świadczenie okresowe stosuje się do roszczeń o odsetki za opóźnienie także wtedy, gdy roszczenie główne ulega przedawnieniu określonemu w art. 554 k.c. Roszczenie o odsetki za opóźnienie przedawnia się jednak najpóźniej z chwilą przedawnienia się roszczenia głównego.
