Uchwała Sądu Najwyższego z dnia 18 października 2001 r., sygn. akt III CZP 56/01, omówiona w Rzeczpospolitej z dnia 07.11.2001: Przedsiębiorca jest obowiązany nie później niż w ciągu dwóch tygodni od zaprzestania płacenia długów zgłosić w sądzie wniosek o ogłoszenie upadłości.
